Terms of Service

These Terms of Service (“Terms”) govern your use of the TowPilot service provided by TowPilot Demo Co. of Toronto, Ontario, Canada(“we”, “us”, or “TowPilot”). By requesting a tow, creating an account, or otherwise using the service you agree to these Terms. If you do not agree, do not use the service.
1. What we do
TowPilot dispatches tow-truck services to customers who request them via our website, phone line, partner motor club, or AI voice agent. We are responsible for assigning a qualified driver, updating the customer on progress, and collecting payment where applicable.
2. Accounts and access
Admin, dispatcher, and driver accounts are created through our authentication provider. You are responsible for keeping your credentials secure and for any activity on your account. Customers do not require accounts to request a tow; they identify themselves via a unique tracking token issued at intake.
3. Fares and payments
Fare estimates shown at intake are based on the service selected, the driving distance between pickup and destination, and applicable accessorials (after-hours, weekend/holiday, dolly, etc.). The final fare is determined at the time of service and may differ based on actual conditions on scene. Disputed charges must be raised within 14 days of job completion.
For motor-club-sourced jobs, billing is routed to the partner club, not to you.
4. Cancellations
You may cancel a tow request at no charge while the job is still in pending or assigned status. Once a driver is en route (accepted or later), a cancellation may be subject to a call-out fee at our discretion.
5. Chain-of-custody photos and signatures
Drivers capture photos of the vehicle before loading and after delivery, and collect a signature from whoever receives the vehicle. These records exist for operational and insurance purposes.
The signature captured in our system serves as an acknowledgment of vehicle handoff. It is not a binding electronic signature under the U.S. ESIGN Act, UETA, or equivalent Ontario, Canada legislation. If you require a binding contract in connection with a tow, please request one in writing.
6. Vehicle condition
Customers are responsible for disclosing vehicle condition accurately at intake. Undisclosed conditions (e.g. a 4WD vehicle reported as a 2WD, an unlisted flat tire, absent keys) may result in additional fees or refusal of service.
7. Impound and storage
Vehicles held in our custody (e.g. after a non-consensual tow or when the owner is unavailable at delivery) accrue storage fees at the posted daily rate from the date of entry. Release requires (a) payment of accumulated fees, (b) government-issued ID matching the registered owner or authorized agent, and (c) clearance of any police hold on file. Vehicles unclaimed past the statutory lien window may be sold to recover fees in accordance with Ontario, Canada law.
8. Limitation of liability
To the maximum extent permitted by law, TowPilot Demo Co.'s total liability for any claim arising out of or relating to the service is limited to the amount you paid us for the specific tow that gave rise to the claim. We are not liable for indirect, incidental, or consequential damages.
9. Governing law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. Any dispute will be brought in the courts of Ontario, Canada.
10. Changes
We may update these Terms. Material changes will be communicated to account holders by email; continued use of the service after changes take effect constitutes acceptance.
